Thư đồng ý về việc xử lý dữ liệu cá nhân của người lao động này (“Thư Đồng Ý”) này được xác lập bởi tôi – Chủ Thể Dữ Liệu, bằng cách chọn vào ô “Tôi đồng ý”, tôi xác nhận đồng ý cho CÔNG TY TRÁCH NHIỆM HỮU HẠN AMPERE COMPUTING VIETNAM có Giấy chứng nhận đăng ký doanh nghiệp số 0305446825 do Sở Kế hoạch và Đầu tư (nay là Sở Tài chính) Thành phố Hồ Chí Minh cấp lần đầu ngày 21 tháng 01 năm 2008 (“Ampere”) thực hiện xử lý dữ liệu cá nhân của tôi theo các điều khoản sau đây:

This Letter of consent on processing of personal data of the recruiting candidate (“Letter of Consent”) is made by me – Data Subject, by ticking the "Agree to the Consent" box, I confirm my consent to AMPERE COMPUTING VIETNAM LIMITED LIABILITY COMPANY having the Enterprise Registration Certificate No. 0305446825 first issued on 21 January 2008 by the Department of Planning and Investment (now the Department of Finance) of Ho Chi Minh City (“Ampere”), to process my personal data in accordance with the following terms and conditions:

1. Sự đồng ý của tôi / My Consent

• Tôi hiểu rằng, dữ liệu cá nhân được xử lý là dữ liệu số hoặc thông tin dưới dạng khác xác định hoặc giúp xác định một con người cụ thể bao gồm dữ liệu cá nhân cơ bản và dữ liệu cá nhân nhạy cảm như được liệt kê tại Điều 2 của Thư Đồng Ý này (“Dữ Liệu Cá Nhân”). Tôi đồng ý để Ampere có thể được tự mình hoặc hoặc chuyển giao cho (i) bất kỳ tổ chức liên kết nào của Ampere, bất kỳ công ty thành viên nào của Tập đoàn Ampere hoặc tập đoàn Softbank (ở Việt Nam, ở Mỹ hoặc ở bất cứ nơi nào khác) (gọi chung là “Các Bên Liên Kết”), và/hoặc (ii) các đại lý, nhà thầu của Ampere hoặc các đối tác có giao dịch bán, mua lại, chuyển nhượng, thay đổi quyền kiểm soát, tái cấu trúc, giải thể hoặc bán doanh nghiệp hoặc tài sản của Ampere (gọi chung là “Các Đối Tác”), và/hoặc (iii) thông qua các nhà cung cấp dịch vụ cho Ampere, các bên thứ ba cung cấp dịch vụ nhân sự, hành chính và/hoặc các dịch vụ khác (bao gồm nhưng không giới hạn các tổ chức tín dụng, doanh nghiệp bảo hiểm, doanh nghiệp cung cấp phần mềm để lưu trữ thông tin cá nhân) (gọi chung là “Các Nhà Cung Cấp Dịch Vụ”), bao gồm nhưng không giới hạn người lao động, bên tư vấn và đại diện khác của Các Bên Liên Kết, Các Đối Tác, Các Nhà Cung Cấp Dịch Vụ, để xử lý Dữ Liệu Cá Nhân (bao gồm nhưng không giới hạn ở hoạt động thu thập, sử dụng, ghi, phân tích, xác nhận, lưu trữ, chỉnh sửa, công khai, kết hợp, truy cập, truy xuất, thu hồi, mã hóa, giải mã, sao chép, chia sẻ, truyền đưa, cung cấp, chuyển giao, xóa, hủy, khử nhận dạng Dữ Liệu Cá Nhân hoặc các hành động khác tác động tới Dữ Liệu Cá Nhân (“Xử Lý Dữ Liệu Cá Nhân”).
  I understand that the personal data is processed is digital data or information in other defined forms or help identify a specific person, including basic and sensitive personal data (“Personal Data”). I agree that Ampere may transfer to (i) any of its affiliates, any member companies of the Ampere Group or SoftBank Group (in Vietnam, in the U.S. or elsewhere) (collectively, the "Affiliates"), and/or (ii) its agents, Ampere's contractors or partners who have a sale, acquisition, transfer, change of control, restructuring, dissolution or sale of Ampere's business or assets (collectively, the "Partners"), and/or (iii) through service providers to Ampere, third parties providing HR services, administrative and/or other services (including but not limited to credit institutions, insurance businesses, businesses providing software to store personal information) (collectively, "Service Providers"), including but not limited to employees, consultants and other representatives of the Affiliates, Partners, Service Providers, to process Personal Data (including but not limited to collection, use, recording, analysis, confirmation, storage, editing, publicity, combination, access, retrieval, recovery, encryption, decryption, copying, sharing, transmit, provide, transfer, erase, destroy, de-identify Personal Data or other actions that affect Personal Data ("Personal Data Processing").

• Tôi có quyền kiểm soát quyết định đồng ý cho Ampere Xử Lý Dữ Liệu Cá Nhân của tôi cho bất kỳ hay tất cả các mục đích được quy định tại Thư Đồng Ý này. Tôi hiểu rằng, nếu không có một số dữ liệu để thực hiện các mục đích nhất định, Ampere sẽ không thể đánh giá sự phù hợp của tôi đối với vị trí công việc tại Ampere hay tuân thủ các yêu cầu của pháp luật, và do đó sẽ không thể đưa ra lời mời làm việc.
  I am entirely in control of my decision to give consent to Ampere for my Personal Data Processing for any or all purposes as specified in this Letter of Consent. I understand that without some data for some purposes, Ampere may not be able to decide on my suitability for employment or comply with the law’s requirements and therefore Ampere may not be able to make an offer of employment.

2. Loại Dữ Liệu Cá Nhân được xử lý, cách thức Xử Lý Dữ Liệu Cá Nhân và thời gian lưu trữ Dữ Liệu Cá Nhân/ Types of Personal Data processed, processing methods of Personal Data and retention time of Personal Data

• Trong thời gian Thư Đồng Ý này có hiệu lực, tôi cho phép Ampere và/hoặc Các Bên Liên Kết, Các Đối Tác, Các Nhà Cung Cấp Dịch Vụ của Ampere được Xử Lý Dữ Liệu Cá Nhân, bao gồm dữ liệu cá nhân cơ bản và dữ liệu cá nhân nhạy cảm của tôi và người thân của tôi, như được liệt kê dưới đây:
  For the duration of this Letter of Consent, I hereby consent to Ampere and/or its Affiliates, Partners, Service Providers to carry out Personal Data Processing, including my basic personal data, sensitive personal data and that of my relatives, as listed below:

• Tùy theo hoạt động mà Ampere và/hoặc Các Bên Liên Kết, Các Đối Tác, Các Nhà Cung Cấp Dịch Vụ có thể thu thập (các) loại Dữ Liệu Cá Nhân nêu trên của tôi và sử dụng cho các mục đích theo nội dung được đề cập ở Điều 4 của Thư Đồng Ý này.
  Depending on the activity, Ampere and/or the Affiliates, the Partners, the Service Providers, may collect the above type(s) of my Personal Data and use it for the purposes mentioned in Article 4 of this Letter of Consent.

• Tôi đồng ý rằng các hệ thống được Ampere dùng để xử lý các Dữ Liệu Cá Nhân nêu trên có thể thay đổi sang các hệ thống xử lý và lưu trữ dữ liệu khác có chức năng tương đương, khi đó, sự đồng ý của tôi theo Thư Đồng Ý này vẫn có hiệu lực đối với việc Xử Lý Dữ Liệu Cá Nhân thông qua các hệ thống thay thế hoặc tương đương đó.
  I agree that the systems used by Ampere to process the aforementioned Personal Data may change to substantially similar systems of processing and storing the data, in which case my consent under this Letter of Consent remains valid for the Personal Data Processing through these systems replacement or equivalent.

3. Chuyển Dữ Liệu Cá Nhân xuyên biên giới/ Cross-border transfer of Personal Data

Tôi hiểu rằng Dữ Liệu Cá Nhân được lưu trữ tại Việt Nam và có thể được Ampere chuyển xuyên biên giới cho các đối tượng được tôi cho phép Xử Lý Dữ Liệu Cá Nhân nêu tại Điều 1 của Thư Đồng Ý này, tùy thuộc nơi đặt máy chủ của các tổ chức, cá nhân đó, nhằm thực hiện các mục đích được nêu tại Điều 4 của Thư Đồng Ý này. Việc chuyển dữ liệu xuyên biên giới sẽ tuân thủ quy định của pháp luật Việt Nam về bảo vệ dữ liệu và an ninh mạng.
I understand that Personal Data is stored in Vietnam and may be transferred cross-border by Ampere to the subjects to whom I authorize the Personal Data Processing set out in Article 1 of this Letter of Consent, depending on where the servers of such organizations and individuals are located, in order to fulfill the purposes set out in Article 4 of this Letter of Consent. Cross-border data transfers will comply with the provisions of Vietnamese data protection and cybersecurity laws.

4. Mục đích Xử Lý Dữ Liệu Cá Nhân/ Purpose of Personal Data Processing

Tôi đồng ý để Ampere và/hoặc Các Bên Liên Kết, Các Đối Tác, Nhà Cung Cấp Dịch Vụ của Ampere được Xử Lý Dữ Liệu Cá Nhân của tôi và những người tham chiếu như được nêu tại Điều 2 của Thư Đồng Ý này cho mục đích thực hiện việc tuyển dụng - ứng tuyển giữa tôi và Ampere, hỗ trợ quản lý và vận hành doanh nghiệp của Ampere, bao gồm các mục đích cụ thể sau:  

• liên lạc, tổ chức phỏng vấn, xác nhận, xác thực và đánh giá năng lực của tôi trong quá trình tuyển dụng;
• thực hiện các hoạt động quản lý nội bộ doanh nghiệp như lao động, hành chính, kế toán, an ninh - an toàn, của Ampere; 
• dùng làm thông tin đầu vào khi tôi được tuyển dụng vào Ampere làm việc;
• lưu thông tin hồ sơ ứng viên tiềm năng cho mục đích tuyển dụng trong tương lai và thực hiện báo cáo nội bộ về công tác tuyển dụng và quản lý nhân sự;
• tuân thủ và thực hiện các nghĩa vụ của Ampere với các cơ quan Nhà nước có thẩm quyền và theo các hợp đồng, thoả thuận đã ký kết với bên thứ ba; và
• thực hiện các quyền và nghĩa vụ khác của Ampere và/hoặc của tôi phát sinh từ việc tuyển dụng theo quy định pháp luật.

I consent to Ampere and/or its Affiliates, Partners, and Service Providers for my Personal Data Processing and the personal data of my referees as specified in Article 2 of this Consent Letter for the purpose of carrying out recruitment activities between Ampere and me, and supporting Ampere’s business management and operations, including the following specific purposes:

• To contact, arrange interviews, confirm, verify, and assess my capabilities during the recruitment process;
• To carry out internal business management activities such as human resources, administration, accounting, security, and safety by Ampere;
• To be used as input information when I am employed by Ampere;
• To retain candidate profile information for potential future recruitment purposes and prepare internal reports on recruitment and personnel management;
• To comply with and fulfill Ampere’s obligations to competent state authorities and under contracts or agreements entered into with third parties; and
• To exercise and perform other rights and obligations of Ampere and/or myself arising from the recruitment process in accordance with applicable laws.

Trường hợp Ampere có nhu cầu Xử Lý Dữ Liệu Cá Nhân của tôi cho một mục đích khác so với những mục đích được tôi đồng ý ở trên, Ampere sẽ thông báo và được sự đồng ý trước của tôi trước khi thực hiện, trừ trường hợp Xử Lý Dữ Liệu Cá Nhân mà không cần có sự đồng ý của tôi theo Điều 9 của Thư Đồng Ý này.

In the event that Ampere needs to carry out my Personal Data Processing for a purpose other than those for which I have consented above, Ampere will notify and obtain my prior consent before doing so, except in the case of Personal Data Processing without my consent under Article 9 of this Letter of Consent.

5. Quyền và nghĩa vụ của Chủ Thể Dữ Liệu/ Rights and obligations of the Data Subject 

(5.1) Quyền của Chủ Thể Dữ Liệu / Rights of Data Subject

• Tôi hiểu rằng, đối với dữ liệu cá nhân mà tôi cung cấp tại Thư Đồng Ý này, tôi có tất cả các quyền luật định với tư cách là chủ thể dữ liệu theo các quy định pháp luật hiện hành, bao gồm: (1) quyền được biết về hoạt động Xử Lý Dữ Liệu Cá Nhân; (2) quyền yêu cầu rút lại sự đồng ý cho phép Xử Lý Dữ Liệu Cá Nhân theo các trường hợp pháp luật cho phép; (3) quyền xem, chỉnh sửa hoặc yêu cầu chỉnh sửa Dữ Liệu Cá Nhân; (4) quyền yêu cầu xóa, hạn chế Xử Lý Dữ Liệu Cá Nhân theo các trường hợp pháp luật cho phép; (5) quyền yêu cầu cung cấp Dữ Liệu Cá Nhân; (6) quyền gửi yêu cầu phản đối Xử Lý Dữ Liệu Cá Nhân; (7) quyền khiếu nại, tố cáo, khởi kiện; (8) quyền yêu cầu Ampere bồi thường thiệt hại; và (9) quyền yêu cầu cơ quan có thẩm quyền hoặc cơ quan, tổ chức, cá nhân liên quan đến Xử Lý Dữ Liệu Cá Nhân thực hiện các biện pháp, giải pháp bảo vệ Dữ Liệu Cá Nhân của mình theo quy định của pháp luật.
  I understand that with respect to the personal data that I provide under this Letter of Consent, I have all statutory rights as a data subject per the applicable laws, including: (1) right to know about Personal Data Processing activities; (2) right to request withdrawal of consent for the Personal Data Processing in cases permitted by law; (3) right to access, review, amend, or request amendment of the Personal Data; (4) right to request deletion of, restriction on the Personal Data Processing in cases permitted by law; (5) right to request provision the Personal Data; (6) right to object to the Personal Data Processing; (7) right to file complaint, denouncements, or initiate lawsuits; (8) right to claim damages; and (9) right to request Competent State authorities or relevant agencies, organizations, or individuals involved in the Personal Data Processing to implement measures and solutions to protect such Personal Data in accordance with applicable laws.

• Tôi có quyền gửi các yêu cầu, khiếu nại và thắc mắc đến thông tin liên lạc được nêu tại Điều 12 của Thư Đồng Ý này và sẽ được xử lý theo quy định của pháp luật hiện hành.
  I have the right to send requests, complaints and queries to the contact address set out in Article 12 of this Letter of Consent and shall be dealt with in accordance with applicable law.

• Các quyền khác theo pháp luật có hiệu lực tại từng thời điểm.
  Other rights as prescribed by relevant laws.

(5.2) Nghĩa vụ của Chủ Thể Dữ Liệu / Obligations of Data Subject

• Tôi cũng cam kết với Ampere các nghĩa vụ sau:
  I also commit to Ampere the following obligations:
  • Tự bảo vệ Dữ Liệu Cá Nhân của mình; đồng thời tôn trọng, bảo vệ Dữ Liệu Cá Nhân của người khác
    Protect my own Personal Data; at the same time, respect and protect other person’s Personal Data.
  • Tôi cam kết Dữ Liệu Cá Nhân cung cấp cho Ampere là đầy đủ, chính xác, hợp pháp, không nằm trong bất cứ loại thông tin nào sau đây: bí mật nhà nước, bí mật kinh doanh và bất cứ thông tin nào khác mà tôi không được phép cung cấp theo quy định của pháp luật hoặc thỏa thuận bảo mật, và luôn được cập nhật nhằm đảm bảo quyền lợi của tôi và Ampere.
    The personal data provided to Ampere is complete, accurate, legal and always updated, does not include any of the following types of information: state secrets, business secrets and any other information that I am not permitted to provide under the provisions of law or confidentiality agreements, and is always updated to ensure the interests of me and Ampere.
  • Thông báo ngay lập tức đến Bộ Phận Bảo Vệ Dữ Liệu Cá Nhân của Ampere qua thư điện tử privacy@amperecomputing.com khi phát hiện hành vi vi phạm về bảo vệ dữ liệu cá nhân.
    Immediately notify Ampere's Personal Data Protection Group at privacy@amperecomputing.com when detecting a violation of personal data protection.
  • Cam kết bảo mật, tuân thủ và thực hiện mọi biện pháp theo chính sách của Ampere và quy định của pháp luật tại từng thời điểm nhằm bảo vệ dữ liệu cá nhân mà tôi có thể được nhận, được biết, tham gia xử lý các dữ liệu cá nhân mà Ampere kiểm soát, xử lý.
    Commitment to confidentiality, compliance and implementation of all measures in accordance with Ampere's policies the applicable laws from time to time to protect personal data that I may receive, know, participate in the processing of personal data that Ampere controls and processes.
  • Chấp hành pháp luật có hiệu lực tại từng thời điểm về bảo vệ dữ liệu cá nhân và tham gia phòng, chống hoạt động xâm phạm dữ liệu cá nhân.
    Comply with applicable laws from time to time on personal data protection and participate in preventing and combating activities that violate personal data.
  • Các nghĩa vụ khác theo pháp luật có hiệu lực tại từng thời điểm.
    Other obligations in accordance with applicable laws from time to time.

6. Lưu trữ Dữ Liệu Cá Nhân/ Personal Data Retention

Dữ Liệu Cá Nhân mà Ampere thu thập được lưu trữ trong hệ thống hồ sơ thông tin dưới dạng bản cứng (bao gồm nhưng không giới hạn ở bản gốc khi pháp luật cho phép, bản sao) và/hoặc dữ liệu điện tử trong hệ thống thông tin của Ampere hoặc của bên thứ ba trong thời hạn phù hợp với mục đích nêu tại Điều 4 của Thư Đồng Ý này. Ampere sẽ thực hiện các biện pháp hợp lý và cần thiết để bảo vệ Dữ Liệu Cá Nhân, giảm thiểu rủi ro Dữ Liệu Cá Nhân bị lạm dụng, can thiệp, mất, bị sửa đổi hoặc tiết lộ trái phép. Ampere sẽ tạo, cung cấp và duy trì hoạt động hệ thống thông tin của Ampere, đồng thời áp dụng các biện pháp quản lý và kỹ thuật phù hợp để lưu giữ và bảo vệ Dữ Liệu Cá Nhân trong khả năng hợp lý của Ampere.
The Personal Data collected by Ampere shall be stored in the information file system in the form of hard copies (including but not limited to original documents if being permitted by law, copies) and/or electronic data in the information system of Ampere or third parties for a period in accordance with the purposes stated in Article 4 of this Letter of Consent. Ampere shall take reasonable and necessary measures to protect the Personal Data, minimize the risk of personal data abuse, interference, loss, illegal alteration or disclosure. Ampere shall establish, provide, and maintain the operation of its information system while implementing appropriate management and technical measures to preserve and safeguard the Personal Data to the reasonable extent of Ampere's capability.

Tôi đồng ý rằng Dữ Liệu Cá Nhân sẽ được lưu trữ kể từ thời điểm phát sinh quan hệ tuyển dụng với Ampere cho đến khi tôi yêu cầu Ampere xóa Dữ Liệu Cá Nhân của mình với điều kiện việc xóa bỏ đó tuân thủ các quy định của pháp luật chuyên ngành, hoặc theo yêu cầu của cơ quan thẩm quyền, trừ trường hợp tôi trở thành người lao động của Ampere, khi đó, Dữ Liệu Cá Nhân của tôi sẽ được lưu trữ theo thỏa thuận giữa các bên và quy định của pháp luật có liên quan.
I agree that the Personal Data will be stored from the moment of initiating the recruitment relationship with Ampere until I request Ampere to delete my Personal Data, provided that such deletion complies with applicable specialized laws or requests from Competent State authorities, unless I become an employee of Ampere. In that case, my Personal Data will be stored according to the agreement between the parties and applicable laws.

7. Kiểm tra tham chiếu/ Reference Checks

Tôi hiểu và đồng ý rằng Ampere có thể tự mình tiến hành kiểm tra lý lịch liên quan đến việc làm của tôi hoặc thông qua bên thứ ba thực hiện việc này thay mặt Ampere. Việc kiểm tra tham chiếu sẽ chỉ liên quan đến thông tin về quá trình làm việc và học tập trước đó của tôi hoặc phạm vi khác được pháp luật cho phép.

Trong trường hợp tôi cung cấp Dữ Liệu Cá Nhân của những người tham chiếu cho Ampere, tôi cam kết và bảo đảm rằng tôi đã thông báo cho bên thứ ba đó và có được sự đồng ý của bên thứ ba đó về việc tiết lộ và để Ampere và/hoặc Các Bên Liên Kết, Các Đối Tác, Các Nhà Cung Cấp Dịch Vụ xử lý các Dữ Liệu Cá Nhân của họ cho các mục đích và quy định được nêu tại Thư Đồng Ý này và bảo vệ, miễn trừ cho Ampere mọi trách nhiệm phát sinh liên quan đến việc Xử Lý Dữ Liệu Cá Nhân này.

I acknowledge and agree that Ampere may conduct an employment-related background check on me either directly or through a third party acting on behalf of Ampere. The reference check will only involve information about my previous work and educational history or within the extent permitted by law.

In the event that I provide Personal Data of referees to Ampere, I represent and warrant that I have notified that third party and obtain that third party's consent to their Personal Data Processing for the purposes and provisions set out in this Letter of Consent and protect, exempt Ampere for all responsibilities arising in connection with this Personal Data Processing.

8. Các rủi ro và những biện pháp an toàn/ Risks and Security Measures 

Tôi hiểu rằng, mặc dù Ampere sẽ thực hiện các biện pháp kỹ thuật và các biện pháp quản lý thích hợp hợp để bảo vệ Dữ Liệu Cá Nhân của tôi theo quy định pháp luật hiện hành, nhưng không thể đảm bảo rằng việc sử dụng, chặn hoặc truy cập trái phép vào Liệu Cá Nhân của tôi sẽ không xảy ra một cách tình cờ hay có chủ đích. Trong trường hợp này, tôi đồng ý và sẽ không yêu cầu Ampere chịu trách nhiệm pháp lý đối với bất kỳ tổn thất, thiệt hại trực tiếp hoặc gián tiếp hoặc hậu quả nào khác mà tôi hoặc bất kỳ người thứ ba nào có thể phải chịu do việc sử dụng, chặn hoặc truy cập trái phép nêu trên.

I acknowledge that, although Ampere will implement appropriate technical and organizational measures to protect my Personal Data in accordance with applicable laws, Ampere cannot guarantee that no unauthorized use, interception of, or access to, my Personal Data will accidentally or intentionally occur. In this event, I agree and will not hold Ampere liable for any direct or indirect loss, damage or other consequences that I or any third person may suffer as a result of such unauthorized use, interception or access.

9. Xử Lý Dữ Liệu Cá Nhân mà không cần có sự đồng ý của Chủ Thể Dữ Liệu/ Personal Data Processing without consent from the Data Subject

Tôi đồng ý rằng Ampere và/hoặc Các Bên Liên Kết, Các Đối Tác, Các Nhà Cung Cấp Dịch Vụ có thể Xử Lý Dữ Liệu Cá Nhân của tôi mà không cần sự đồng ý của tôi trong các trường hợp sau đây:

I agree that Ampere and/or its Affiliates, Partners, Service Providers may process my Personal Data without my consent in the following circumstances:

• Để bảo vệ tính mạng, sức khỏe, danh dự, nhân phẩm, quyền, lợi ích hợp pháp của tôi hoặc người khác trong trường hợp cấp bách; hoặc bảo vệ quyền, lợi ích chính đáng của tôi, của người khác hoặc lợi ích của Nhà nước, cơ quan, tổ chức một cách cần thiết trước hành vi xâm phạm lợi ích nói trên;
  To protect my life, health, honor, dignity, rights, or legitimate interests, or those of another person, in urgent cases; or to protect my own legitimate rights and interests, those of another, or the interests of the State or an organization/agency as necessary against acts infringing such interests;
• Để giải quyết tình trạng khẩn cấp; nguy cơ đe dọa an ninh quốc gia nhưng chưa đến mức ban bố tình trạng khẩn cấp; phòng, chống bạo loạn, khủng bố, phòng, chống tội phạm và vi phạm pháp luật;
  To handle emergency situations; risk of threatening national security but not to the extent of declaring a state of emergency; to prevent and combat riots, terrorism, crimes, and legal violations;
• Phục vụ hoạt động của cơ quan nhà nước hoặc hoạt động quản lý nhà nước theo quy định của pháp luật;
  To serve the activities of state agencies or state management as prescribed by law;
• Thực hiện thỏa thuận mà tôi đã ký với cơ quan, tổ chức, cá nhân có liên quan theo quy định của pháp luật; và
  To implement an agreement I have with relevant agencies, organizations, or individuals as prescribed by law; and

10. Xử Lý Dữ Liệu Cá Nhân trong trường hợp không tuyển dụng / Personal Data Processing in the event of non-recruitment

Tôi tại đây đồng ý rằng, trong trường hợp tôi không được tuyển dụng sau quá trình ứng tuyển, kể từ ngày Ampere thông báo kết quả tuyển dụng chính thức, Ampere vẫn được phép tiếp tục Xử Lý Dữ Liệu Cá Nhân của tôi trong thời gian không vượt quá khoảng thời gian lưu trữ cho mục đích quy định tại Điều 4 Thư Đồng Ý này.

I hereby agrees that, in the event that I am not selected for employment following the recruitment process, from the date on which Ampere issues the official recruitment result, Ampere shall remain entitled to continue processing my Personal Data for a period not exceeding that necessary to fulfil the purposes set out in Article 4 of this Letter of Consent.

11. Hiệu lực / Effectivenes

Thư Đồng Ý này có hiệu lực kể từ ngày Chủ Thể Dữ Liệu nộp đơn xin việc đến khi có văn bản/thỏa thuận khác thay thế hoặc tôi rút lại sự đồng ý của mình bằng văn bản. Thư Đồng Ý này được xem là thỏa thuận hoàn chỉnh và độc quyền về việc thu thập và xử lý Dữ Liệu Cá Nhân và thay thế tất cả các đề xuất, thảo luận, thỏa thuận hoặc cam kết trước đó, được lập bằng lời nói hoặc bằng văn bản, giữa Ampere và tôi về các vấn đề nêu trên.

This Letter of Consent takes effect from the date the Data Subject applies for the job application until there is another agreement to replace it or until I withdraw consent hereof in writing. This Letter of Consent constitutes the complete and exclusive agreement on the collection and processing of Personal Data and supersedes all prior proposals, discussions, agreements or undertakings, made orally or in writing, between Ampere and I on the foregoing matters.

12. Thông tin liên lạc / Contact Details

Nếu tôi, vào bất cứ lúc nào, muốn (i) hỏi về cách Ampere thu thập, sử dụng, bảo vệ và/hoặc xử lý Dữ Liệu Cá Nhân của tôi; hoặc (ii) thực hiện các quyền tôi có đối với Dữ Liệu Cá Nhân của tôi, tôi sẽ liên hệ với nhân sự phụ trách của bô phận bảo vệ dữ liệu cá nhân của Ampere theo thông tin sau: privacy@amperecomputing.com.

If I, at any time, wish to (i) enquire about how Ampere collects, uses, protects and/or processes my Personal Data; or (ii) exercise the rights I have with respect to my Personal Data, I will contact personnel in charge of Ampere's personal data protection department according to the following information: privacy@amperecomputing.com.

13. Xác nhận và chấp thuận/ Acknowledgement of Receipt and Consent

Tôi xác nhận rằng, thông qua Thư Đồng Ý này, tôi đã được thông báo một cách đầy đủ, rõ ràng và minh bạch về việc xử lý Dữ Liệu Cá Nhân, bao gồm cả dữ liệu cá nhân nhạy cảm, với các nội dung mục đích xử lý Dữ Liệu Cá Nhân; loại Dữ Liệu Cá Nhân được xử lý; cách thức xử lý Dữ Liệu Cá Nhân; thông tin về các tổ chức, cá nhân có liên quan đến việc xử lý Dữ Liệu Cá Nhân; hậu quả, thiệt hại không mong muốn có khả năng xảy ra; và thời gian bắt đầu và thời gian kết thúc việc Xử Lý Dữ Liệu Cá Nhân. Thư Đồng Ý này không hạn chế bất kỳ quyền nào đối với việc Xử Lý Dữ Liệu Cá Nhân mà không cần phải được sự đồng thuận theo quy định của pháp luật Việt Nam.

I acknowledge that, by signing this Letter of Consent, I have been fully, clearly and transparently informed of the processing of Personal Data, including sensitive personal data, with the following details the purpose of processing the Personal Data; the types of Personal Data to be processed; the method of processing the Personal Data; information on the organizations or individuals involved in the processing of the Personal Data; potential unintended consequences or damages; and the commencement and end time of the Personal Data processing. This Letter of Consent does not limit any right to Personal Data Processing without consent to the extent permitted by Vietnamese laws.

Bằng cách tích chọn vào ô “Đồng ý” , tôi xác nhận rằng Tôi đã đọc và hiểu toàn bộ nội dung của Thư Đồng Ý này và đồng ý cho Ampere và các đối tượng được tôi cho phép Xử Lý Dữ Liệu Cá Nhân nêu tại Điều 1 của Thư Đồng Ý này. Ampere không cần thực hiện việc thông báo riêng lẻ cho từng hoạt động xử lý Dữ Liệu Cá Nhân dù là Dữ Liệu Cá Nhân cơ bản hay nhạy cảm đã được đề cập tại đây.

By ticking the “Agree” box, I acknowledge that I have read and understand this Letter of Consent and that I consent to Ampere’s processing of my Personal Data as described at Article 1 within this Letter of Consent. Ampere is not required to issue separate notifications for each Personal Data Processing activity, whether involving basic or sensitive Personal Data, as referred to herein.

Trong trường hợp có xung đột về ngôn ngữ, ưu tiên áp dụng cách hiểu bằng tiếng Việt. Thư Đồng Ý này được điều chỉnh và giải thích theo quy định của pháp luật Việt Nam.

In case of any conflict between the Vietnamese and English languages, Vietnamese content shall prevail. This Letter of Consent is adjusted and conforms to the regulations as prescribed by Vietnamese laws.

Mọi khác biệt hoặc tranh chấp giữa các bên phát sinh từ hoặc liên quan đến Thư Đồng Ý này mà Ampere và tôi không tự thỏa thuận được sẽ được giải quyết bởi Tòa án có thẩm quyền tại Việt Nam. Quyết định/bản án được ban hành bởi Tòa án sẽ có hiệu lực bắt buộc đối với các bên được quy định tại Thư Đồng Ý này.

Any differences or disputes arising out of or in connection with this Letter of Consent that cannot be resolved through mutual agreement between Ampere and me shall be settled by a competent Court in Vietnam. The decision/judgment issued by the Court will be binding on the parties regulated in this Letter of Consent.

Việc tôi xác nhận đồng ý vào Thư Đồng Ý này là hoàn toàn tự nguyện, không bị lừa dối hoặc ép buộc.

My acceptance of this Letter of Consent is completely voluntary, without deception or coercion.
